- in section 4 - Decision to take formal action: to add a
legislation reference in regards to referral to Commissioner
of Police;
- in section 10 - Breach hearing: to add "Officers
conducting disciplinary hearings must assess the language and
comprehension skill of the prisoner, and ensure that the
prisoner understands the proceedings";
- in section 10 to add "[If in the event that a prisoner
states the referring officer did not comply with an Agency
procedure or process, this must be recorded on the Form 23 eg.
non compliance with substance testing procedure]";
- in section 10 to add "Deciding officers and reviewing
officers must record adequate reasons for their decision on
the Form 23 and provide those reasons to the prisoner";
- in section 11 - Consequences of a breach of discipline: to
add "The payment of restitution is not to be considered by a
deciding or reviewing officer in the breach process.
This is a separate process delegated to the general manager or
assistant general manager"; and
- in section 12 - Review of decision: to add "The deciding
officer must not make any comment that would influence the
prisoner's decision on whether to seek a review of a
decision".
Appendix - Breach Penalty Guidelines has been amended-
- by adding that tariffs are applicable to both major and
minor breaches and that minor breaches must only receive a
loss of privileges of less than 24 hours;
- to increase the range of all tariffs so that the range
starts at one day; and
- to remove the note which stated which breaches could
result in the recovery of monies.
Appendix - Prisoner Information Booklet has been amended in
section 2.3 - Prisoner conduct, Breaches of discipline: to add
if the breach is proven and the circumstances around the breach
determines that the prisoner's behaviour is a threat to the
safety and good order of the residential compound, the prisoner
may be transferred to secure accommodation.

Applicants has been amended-
- to add in section 5.1 - Removal of a person's details from
the Victims Register under CSA s 342(1)(a)-(b): that a
person's details must be removed from the Victims Register
when an offender is discharged on their full time release
date, discharged from a parole order, discharged from a
prison-probation order or is discharged from a supervision
order under the
Dangerous Prisoners (Sexual Offenders) Act 2003; and
- to add new section 5.2 - Removal of a person's details
from the Victims Register under CSA s 342(1)(c): which was
previously apart of section 5.1.
Procedure - Visitors to a Facility (Excluding Personal
Visitors) has been amended-
- by rearranging the order the sections are listed and to
categorise each section under different parts: Part A - Rules
applicable to all professional and other visitors, Part B -
Visitors other than prescribed persons and Part C - Prescribed
Persons;
- in section 2 - Application to visit to outlines to change
accredited person to prescribed and that this type of visitor
need not apply for access approval. This section also
outlines who is a prescribed person;
- in section 3 - Approval to visit: to add that the general
manager is required to approve prescribed visitor access,
however the general manager need not consider whether the
prescribed visitor poses a threat to the security or good
order of the facility;
- to move in section 4 - Identification: that persons over
18 years of age may be required to register for electronic

Literacy and numeracy assessment using TAFE Queensland

developed to provide guidance for the identification and
assessment of suitable prisoners for placement in low custody.
Procedure - Breaches of Discipline has been amended to
emphasise CSA s 116(6), which indicates that an offender may be
disadvantaged by language barriers or impaired mental capacity
and so may be helped by someone from the facility.
Procedure - Child Protection - Reportable Offenders has been
amended to in section 4 to ensure that the Acknowledgement from
included in the Notification kit is completed and forwarded to
the Queensland Police Service when the prisoner is given the
original Notice and Brochure.
Procedure - Mail - Offender Mail has been amended to move
"Offenders subject to a domestic or family violence protection
order are not permitted to contact people identified in that
order" from section 22 to section "1 General".

probation and parole office has a district manager
(section 10).
The Mobile Telephones procedure has been amended by adding in section 2:
- If the offender cannot or will not nominate a person
or location to have the item forwarded to, the mobile
telephone must be seized as a prohibited thing and
forfeited to the State. The offender must be issued a Form
25 - Receipt for Seized Property) and be advised
of this decision and the reasons for it (refer Form
26 - Notice of Forfeit of Seized Thing).
- Mobile telephones forfeited to the State must be held
for the required 28 day period before being disposed of
via a registered charity or recognised mobile telephone
recycler.
- Any mobile telephones being held pending collection by
or forwarding to a third party are to be stored in a
secure location approved by the general manager,
external to the facility (eg the visits processing
area). Facilities that do not have such a location must
store the mobile telephones in a secure location within
the gatehouse.

- "Major Incident Log - At-Risk Management - Probation and Parole" was created to
provide a standardised documentation mechanism for Probation and Parole officers
to record details of major self harm/suicide incidents;
- "Observation Log - At-Risk Offender" by removing "registered nurse" as a designated
person to complete the observation log; and
- "Transfer Summary" to enable the transfer of at-risk information between Probation
and Parole and Custodial.

- consistency for an independent assessment capacity and subsequent advice to Custodial
Operations in relation to the operational implementation of recommendations. The
suggested time frames are sufficient to provide motivation to the facility for completion
and is a reasonable and practical period. The GM is provided support at regular
intervals prior to the follow up inspection from a number of resources. Further,
it provides the Custodial Operations Directorate with sufficient time prior to the
follow up inspection by the Office of the Chief Inspector to take any necessary
directive or remedial action in respect to any outstanding recommendations; and
- a greater level of confidence in reporting to the Director-General on operational
change at the facility level when reporting on progress.

developed to replace the Initial Surveillance Assessment - Revised (ISA-R) and is
due for implementation with version 1.10 of IOMS. The IRNA-PPV provides further
guidance for probation and parole officers when conducting the assessment including
examples of questions/areas to consider when assessing immediate risk and need/s
and planning needs.
- Amendments made to the Admission procedure are outlined below:
- the admission process includes conducting an Initial Risk Need Assessment - Probation
and Parole Version (IRNA-PPV) (section 1 and 13);
- completion of the RoR-PPV is not required for offenders subject to a DPSOA supervision
order in order to protect the statistical accuracy of the tool (Section 14). The
RoR-PPV is unable to calculate numbers of current offences for DPSOA supervision
orders as offences are not entered on this type of order;
- inclusion of the purpose and timeframes for completion of the IRNA-PPV (Section
15); and
- removed reference to the ISA-R throughout the procedure.
Assessment - version 07
- The Assessment procedure has been reviewed to provide field staff with direction
on administering the IRNA-PPV.
- Amendments made to the Assessment procedure are outlined below:
- section 1.1 was amended to include immediate risk and need/s, general planning needs
and level of service as assessment outcomes for the Queensland Corrective Services
(QCS);
- sources of information should also include traffic history, police briefs, professional
reports, other persons, external organisations or other Government departments (section
1.2);
- assessment officers must perform substance testing requirements and contravention
actions until completion of the assessment and planning process (section 3);
- include section in relation to supervision frequency - assessment phase until completion
of the Offender Management Plan (OMP) and reference to appendix - Supervision Frequency
Guidelines (section 3.2);
- completion of the RoR-PPV is not required for offenders subject to a DPSOA supervision
order in order to protect the statistical accuracy of the tool (section 3.3). The
RoR-PPV is unable to calculate the number of current offences for DPSOA supervision
orders as offences is not entered on this type of order;

- The appendix - Level of Service Allocation Criteria has been amended to state Serious
Violent Offence, declared in sentencing rather that Serious Violent Offender.

- reference to the ISA-R replaced with IRNA-PPV (sections 3.2, 5 and 8 (i));
- any general planning needs are also to be included in the development of the OMP
(section 5);
- development of the OMP should also incorporate assessments of supervision management
(section 8 (h));

- recommendations for placement should refer to custodial operations only (section

- The appendix - Supervision Frequency Guidelines has been developed by the Probation

- Amendments made to the procedure are outlined below:
- replace all references to surveillance level with supervision frequency in accordance
with the new standards and appendix developed by Probation and Parole Directorate
to support the Probation and Parole Model (section 1, 2.4, 2.5, 3.1);

The Mail - Offender Mail procedure has been amended to provide for the new process.
The procedure has been amended by inserting the following to section 2.2 - Search
and censor of ordinary mail -
- The offender must clearly write their name on the back flap of the envelope. A stamp
must be placed on the back of the envelope that provides the facility's mail address
and a contact phone number.
The procedure has further been amended with the inclusion of section 2.3 - Unwanted
Mail where it provides -
- The stamp placed on the back of the envelope will allow the recipient of the mail
to contact the facility if they do not want to receive further mail from the offender.
If contact is made, the recipient or their written response is to be referred to
an Intelligence Officer. The Intelligence Officer must ensure that the recipient
and the offender are recorded on the targeted mail register. The offender must also
be advised of the 'stop mail' condition put in place by the recipient. Any further
mail sent to the recipient by the offender is to be seized and returned to the offender.
General Managers should develop a local procedure to facilitate the process if necessary.

new section -
- Moral rights are personal rights that are granted to individual authors of copyright
protected works. Authors hold moral rights in significant works even if the copyright
in the material they produce belongs to their employer.
Authors have three (3) moral rights which are -
- a) right of attribution of authorship;
- b) right against false attribution of authorship; and
- c) right of integrity of authorship.
A significant work is usually a substantial/major work or work of a technical nature
that is the result of considerable creative effort. Works of a purely administrative
nature, such as briefs, submissions and media releases would not be significant
works.
The Manager, Financial Management is responsible for establishing a register of
employees who have authored significant works and specify if they have been attributed
or not and, if not, the reason why they have not been attributed.

admission, the following must occur?
- the offender should be asked whether they would like contact to be made with their
primary contact/s to make the aware of the offender's admission to an external medical
facility;
- where the offender is not able to be asked permission for contact to be made with
the offender's primary contact/s the general manager or nominee must consider the
nature of the offender's medical condition, expected duration of the offender's
admission to an external medical facility, relevant security/escape related information
and determine whether the offender's primary contact/s should be advised of the
offender's admission.
The general manager or nominee will be responsible for making contact with the offender's
primary contact/s where consented to under a) or determined necessary under b).
The Health Services Coordinator must ensure that the external medical facility has
an up to date record of the offender's primary contact/s details.
- the addition of section 12. Clothing supplied to an offender admitted to an external
medical facility for an extended period. This section provides that where an
offender is to be admitted to an external medical facility for more than a 24 hour
period, the offender must be transferred with a clean set of prison clothing, personal
underwear and toiletries.

In April 2007, the Office of the Chief Inspector conducted a review to examine the
process and practices associated with involuntary inter-regional offender transfers,
particularly in relation to indigenous prisoners from Lotus Glen and Townsville
Correctional Centres. These involuntary transfers were the result of the Agency's
capacity utilisation initiative in the period February 2006 to January 2007.

The Chief Inspector made a total of 24 recommendations, including practice and procedural
changes.
- The procedural changes capture the revised protocols including a structured approach
to the selection, notification, education and support of prisoners in an involuntary
transfer scenario. Specific guidance and provisions for involuntary transfers have
been included in the procedure, as well as minimum standards of accommodation to
be provided for long distance transfers.

The procedure has been amended to reflect the changes in the legislation. The amendments
include the following -
- Section 4. Moral Rights has been added to the procedure. According to this
section moral rights relate to personal rights belonging to the creator of copyright
works and cannot be transferred, assigned or sold. The creator has the right to
be attributed for their work, not to have their work falsely attributed and not
to have their work treated in a derogatory way. Any issues in relation to copyright,
intellectual property and moral rights must be resolved prior to the artwork/craft
being subject to the ACPO.
- Section 5. Artwork/Craft retained by offenders has been amended to comply
with the procedure - 'Property of Offenders'. If approved by the general manager
of the corrective services facility, offenders may retain their completed artwork/craft
in their cell.
- The section Management by the Public Trustee has been removed from the
procedure to ensure practices where an agreement between an offender and the Agency
is legitimate.
- Section 6. Limitation of liability outlines the partnership with the Department
of Education, Training and the Arts, to assist QCS in determining appropriate pricing
of pieces of artwork/craft.
- According to the amended section 7.2 Exhibition/Display of artwork/craft through
the ACPO the artwork/craft for exhibition must not contain material that-
- is offensive;
- is of a provocative nature, for example racist;
- is sexually explicit; and/or
- depict violence or threatening images.
- Section 7.2 Exhibition/Display of artwork/craft through the ACPO
also outlines that artwork/craft may be displayed for sale by electronic means on
the QCS internet and intranet sites subject to an offender signing the administrative
form - 'Application to Donate Artwork/Craft'.
- Section 11. Sale of donated artwork/craft and Section 12. Sale of artworks
to employees and engaged service providers clarify that all sales of donated
artwork/craft must be coordinated through the Project Officer, ACPO.

- A new section 4.1 Discharge from custody to court ordered parole has been
inserted to provide a process for the discharge of offenders from custody to court
ordered parole. The section commences with an outline of the responsibilities of
custodial staff and provides a process for:
- sentence management staff at a corrective services facility in the week preceding
court ordered parole release dates;
- ensuring that all offenders attend an individual/group initial report with a probation
and parole offices at the facility prior to court ordered release;
- updating the relevant sections on IOMS; and
- providing copies of the form 31 - Court Ordered Parole Order and new administrative
form -
Court Ordered Parole Reporting Notice to the offender.
- Section 4.1 also outlines the responsibilities of probation and parole staff in
relation to offenders, including a requirement to personally visit custodial facilities
once a week to conduct an initial report, prior to an offenders release to court
ordered parole.
- The section also provides that in instances where an offender has been sentenced
to a period of imprisonment for less than seven days an may not be available to
attend a probation and parole initial report prior to release, that the role of
the probation officer is to be performed by sentence management staff.
- The purpose of the initial report is explained in section 4.1 where upon visiting
the facility the probation and parole officer :
- explains the condition and consequences of failing to comply;
- advises the offender they must seek approval for travel;
- obtains the offender's personal contacts and confirms with the offender;
- establishes the probation and parole district office/reporting centre that the offender
is to report to following release;
- contacts the probation and parole district office/reporting centre to make an appointment
on the offender's behalf for his/her next report; and
- provides a record of the details of the appointment to the offender, relevant district
office and to sentence management staff.
- In section 5. Travel arrangement - custody the paragraph provided for the
Regional Director, Northern Region to support the travel expenses for an Aboriginal
or Torres Strait Islander offender wishing to return to his/her community has been

Where an offender or other person makes a threat against a staff member or his/her
family that is not directly made to the staff member, the following must occur as
soon as practicable but no later than 24 hours after the threat has been made -
- the officer who becomes aware of the threat made to another staff member must
complete an incident report documenting the threat irrespective of whether the threat
was considered to be of a serious nature or not (refer appendix ? Code and Incident
Definitions ? 606) and the report must be submitted to a supervising officer;
- the supervising officer must enter the incident report into IOMS and advise
a line manager;
- the line manager endorsing the IOMS incident report must advise the staff member
who is the subject of the threat of the nature and content of the threat and that
an incident report has been completed. The line manager must also inform the staff
member's district manager or general manager of the incident.
- The following amendment has been made to section 2 to ensure that the use of force
by a corrective services officer is reported in IOMS-
2. Reporting an incident
Where an incident involves the use of force by a corrective services officer, this
must be recorded in the IOMS incident report. This involves selecting the 'Use of
Force' check box that will then open a 'Use of Force' tab page. If the incident
was resolved by negotiation or communication the 'Yes' check box may be endorsed
and no further information in the Use of Force tab page is required. If 'No' is
selected, all reference data in the open fields must be completed.

to interview offenders to determine their suitability to be sentenced to an Intensive
Drug Rehabilitation Order (IDRO).
A Queensland Health staff member attending a facility to perform an assessment function
for a Drug Court is a government visitor in accordance with section 3.1 of this
procedure. A staff member of a cooperating organisation performing an assessment
function is a professional visitor in accordance with section 3.4.
QCS is committed to assisting these staff in the performance of their duties and
ensuring Drug Court objectives are met.

- Section 3.2 Probation and Parole Service has been amended to outline that:
- For offenders who receive an Offender Risk Needs Inventory - Revised (ORNI-R), the
development of the OMP occurs following administration of the ORNI-R and must be
completed within seven weeks of admission. The OMP with the ORNI-R must be verified
at the offender management team meeting within two weeks following admission.
- For offenders who do not receive an ORNI-R, the development of the OMP occurs following
administration of the Inital Surveillance - Revised (ISA-R) and should be completed
and verified within four weeks of admission.

Inter-Facility Prisoner Contact

- The procedure has been amended to provide that:
- offenders may be approved for inter-facility visits and may travel to visit an offender
at another facility;
- low classified offenders may visit high security offenders but the visit must occur
at the centre where the high security offender is accommodated unless there are
exceptional compassionate circumstances approved by the Executive Director;
- high security classification offenders may only be approved for telephone and video-conference
contact with another high security classification offender; and
- offenders who request and are not granted inter-facility visits because of their
security classification should be granted an inter-facility video-conference.
- The amended procedure also provides that, for an offender accommodated at a high
security facility who has been granted inter-facility visit, a search requiring
the removal of clothing must only occur upon leaving from and returning to the facility
at which they are accommodated. An exception to this is where there is a reasonable
suspicion that the offender is concealing contraband. If there is a reasonable suspicion
a further search requiring the removal of clothing may be conducted by the receiving
facility.

- Section 10.2 Visitor identification has been amended to include:
"Where an electronic scanning or biometric identification system is available at
a corrective services facility, visitors 18 years of age or older must be registered
on the system. The visitor must be processed on the system when accessing the facility.
If an adult registered on the identification system attends the facility with children
under the age of 18 years, these children may enter the mantrap with the adult to
gain access to the facility. Refer CSA ss 162, 163; and appendix - Biometric Identification."
- The creation of the appendix - Biometric Identification outlines how the biometric
information is recorded, stored and used. This will be made available in gatehouses
and visits areas to inform the public and staff.

This procedure details the processes required of corrective services facility management
to ensure a consistent approach is taken in addressing employee-
- workplace attendance;
- absenteeism;
- workplace health and safety;
- and rehabilitation.
In addition, the procedure provides guidance regarding-
- Human Resource Manager's and Assistant General Manager's functions;
- the interview process for assessing support and supervision needs for employees
who have difficulty engaging in work duties; and
- referral to the Workforce Support and Strategy Unit, Human Resource Services Branch
when interventions have been unsuccessful.

Computers - Offender Access to In-Cell Computers

- Due to difficulties with security and the management of the use of the resource,
offenders who are accommodated at a Work Camp will not be eligible for use
of In-Cell Computers.
- To address the above issue the procedure has been amended. Section 1. Process
of the procedure now reads:
"An offender may access an in-cell computer only for an approved educational or
vocational program identified in the offender's management plan. In-cell computers
must not be approved for legal purposes or recreational use or offenders who are
accommodated at a Work Camp."

the notification to QPS of a reportable offender's return to custody by adding:
"If a reportable offender who has been identified with the Australian National Child
Offender Register (ANCOR warning flag in IOMS) is readmitted into corrective services
custody, the Child Protection Offender Registry (CPOR) must be notified as soon
as practicable by faxing administrative form - Notice to CPOR of Particular Event
under CPORA to (07) 3236 0273."
- Section 5 has been amended by deleting dot point b) and c) and replacing with:
- ensure the Police transfer document is signed by the escorting Police officer,
the Reception Store officer and the offender; and
- provide a copy of the Police transfer document to the escorting Police officer
as confirmation of the receipt of the offender.
