How do I make an application for access to documents?

Section 25 of the FOI Act provides that applications must:

  • be in writing (this can be done by letter, an application form is not necessary)
  • include a good enough description of the documents requested for QCS to locate them
  • specify an address for notification of a decision

When an application is made for documents that do not concern the applicant's personal affairs, an application fee will be payable, and processing and access charges may apply. Please refer to fees and charges.

If an application is made for documents that solely concern an applicant's personal affairs, proof of identification will be required before any documents can be released. It is best if it accompanies the application. An example of appropriate identification is a photocopy of the applicant's birth certificate, passport or driver's licence which has been sighted and certified as a true copy by a Justice of the Peace or solicitor.

Once the FOI Unit receives an application for access, it is required to notify the applicant of a decision on access within 45 days, or 60 days if it is necessary to consult with one or more third parties about release of the documents. The time may be extended if payment is requested, as the 'clock stops' until the fee is paid and the applicant pays, or agrees to pay, any relevant charges.

Freedom of information access applications should be posted to:

Freedom of Information & Privacy Unit
Queensland Corrective Services
GPO Box 1054
BRISBANE QLD 4001

Alternatively, an electronic application can be lodged at www.smartservice.qld.gov.au/services/information-requests/ (Please note: This function will be available as of 8th December 2008).
